GILROY SQUARE
NOTICE OF INTENT
The City of Gilroy Planning Division intends to adopt a Mitigated Negative Declaration for the following project in accordance with the California Environmental Quality Act (CEQA) of 1970, as amended, and the Thresholds of Significance adopted May 3, 2004 by the City of Gilroy.
PROJECT DESCRIPTION
The Gilroy Square project includes a proposal to subdivide APN 841-070-049, 10.07 acres, into six (6) lots, and an Architectural and Site Review permit to approve development of the lots as Phase II of the Regency Center Planned Unit Development (PUD). The project includes construction of two, four-story hotels, a drive-through fast food restaurant, a gas station with convenience store and carwash, and speculative industrial warehouse buildings proposed as future development.

PROPOSED ELECTRONIC BILLBOARD
NOTICE IS HEREBY GIVEN that the City of Gilroy Planning Division intends to adopt a Mitigated Negative Declaration for the following described project in accordance with the California Environmental Quality Act (CEQA) of 1970, as amended, and the Thresholds of Significance adopted May 3, 2004 by the City of Gilroy:

Project Title: Electronic Billboard Ordinance and Sign Permit

Project Description: The proposed project requests approval to construct and operate a 75-foot tall electronic billboard with a 672 square foot display area, within the Gilroy city limits. The project requires amendment of Section 30.37.30 (Prohibited Signs), Section 30.37.50 (Commercial and Industrial Districts), and Section 30.37.51 (Freeway Oriented Signs) of the Gilroy Municipal Code to allow such signage which is currently prohibited. The project also includes a new Zoning Code Ordinance (Article LV, Electronic Billboards) which would permit a maximum of two electronic billboards within the City on property with a General Plan designation of General Services Commercial or City Gateway District, located within 660 feet of U.S. Highway 101 (US-101).
Environmental Review: In accordance with Section 15070 of the California Code of Regulations, the City of Gilroy Planning Division has determined that there is no substantial evidence that the proposed project would have a significant effect on the environment, and that a mitigated negative declaration (MND) may be adopted. The environmental public review period began on August 5, 2022 and ended on September 6, 2022. Staff will continue to accept comments from the public until a decision is rendered by the City Council following review by the Planning Commission.
Appeal Received: On February 2, 2023, the Planning Commission denied the proposed Ordinance and recommended denial of the Final IS/MND. On February 21, 2023, the City received a joint appeal from the Project applicant Mike Conrotto and Outfront Media, the outdoor media company that would potentially construct and operate an electronic billboard in Gilroy. This would only occur if the Ordinance is adopted and a subsequent application for construction of a billboard is approved on property owned by Mr. Conrotto through a separate application process.

City Council Public Hearing: On March 20, 2023, the City Council will hold a public hearing on the appeal to adopt an Ordinance allowing up to two (2) electronic billboards in the City of Gilroy. This is a De Novo Hearing at which the Council will decide if the environmental review is adequate, and if so, whether or not to introduce the Ordinance. https://cityofgilroy.org/965/City-Meetings-Videos-Agendas-Minutes-Por One you open the link, go down to current and upcoming meetings. If the appeal is denied by the Council and the Planning Commission’s denial (with prejudice) is upheld, the applicant cannot reapply for the proposed Ordinance amendment for one year from the Planning Commission’s February 2, 2023 decision (February 2, 2024). However, the City Council could waive the one (1) year waiting period if the Council determines that significant new material or facts are present which justify reconsideration of a zone change through refiling of the application.
If the appeal is approved by the Council, the Council would make a motion to adopt the MND and introduce the zoning ordinance amendments. The proposed Ordinance would come back to the City Council for a second reading, approximately four weeks following the first reading. If the Ordinance is subsequently approved by the City Council, the Ordinance would take effect 30 days following the second reading of the Ordinance. The applicant, or any other applicant, could then submit a proposal for an electronic billboard in conformance with the adopted Ordinance.
Planning Commission Public Hearings: On January 19, 2023, the Planning Commission reviewed the application but continued the hearing for further discussion on February 2, 2023. The staff report, attachments, and public comments are available through the Gilroy meeting portal. On February 2, 2023 the Planning Commission continued the Public Hearing and voted to deny the application, including the Final IS/MND (see below) and the Ordinance request. Comments received after publication of the 2/2/23 meeting packet and prior to 11:59 PM on 2/2/23 were posted on the City's Public Comment portal.

The Chestnut and Tenth Street Commercial Project proposes to demolish the existing Chestnut Center and construct a new 120-room hotel, carwash, four commercial buildings that include drive through services and a gasoline service station. The four commercial buildings and carwash would total approximately 19,649 square feet. The site would be subdivided into six separate parcels. The City of Gilroy Planning Division intends to adopt a Mitigated Negative Declaration (MND). Public review of the MND begins on June 25, 2021 and ends on July 26, 2021. The Glen Loma Ranch Development is located in the western rolling foothills of Gilroy Between Santa Teresa Boulevard and Uvas Creek. The site was historically part of Henry Miller's ranch enterprise and has been owned by the Filice family since the 1930s. The specific plan for this development was approved in 2005 after a process that involved city officials, planners, and input from the local community.
The site will feature 17 distinct neighborhoods filled with trails, open space, and a town center. The neighborhood will be in close proximity to schools such as Las Animas Elementary School, Ascencion Solorano Middle School, and Gilroy High School. The neighborhoods will also be in close proximity to Christmas Hill Park.

The Hecker Pass Apartments project approval permits a 100-unit affordable housing apartment complex on 3.81 acres located at the southwest corner of Santa Teresa and Hecker Pass. The project was exempt from environmental review as an in-fill affordable housing development project.

The project is currently under construction. The project was exempt from environmental review as an in-fill affordable housing development project.
